Mr

Kenneth H. Podpeskar

Mr. Podpeskar concentrates his practice on compliance monitoring and counseling, Superfund cleanups, property transfers, and solid and hazardous waste issues. Prior to becoming an attorney, Mr. Podpeskar worked as an engineer for eight years at the Minnesota Pollution Control Agency, where he was supervisor of the Solid Waste Permits Unit.

As an attorney, Mr. Podpeskar has represented clients in solid and hazardous waste permit and enforcement negotiations with county, state and federal regulators. He has conducted facility compliance audits and coordinated the establishment of corporate compliance programs for a number of clients. Mr. Podpeskar also has worked extensively with corporations and financial institutions on properly addressing environmental issues arising in corporate or property acquisitions or sales.

Mr. Podpeskar has prepared clients for and has coordinated responses to multimedia inspections by the Environmental Protection Agency (EPA). Mr. Podpeskar has negotiated with EPA and has developed approaches with state and local agencies on innovative methods regarding waste, tank and cleanup requirements under EPA's Project XL Program.

In addition, Mr. Podpeskar was actively involved in creating and executing the Printing Industry of Minnesota Partnership Agreement with the Minnesota Pollution Control Agency. He was an adjunct professor of environmental law at William Mitchell College of Law and co-authored an article entitled Environmental Considerations in a Railroad Land Purchase in the Transportation Practitioners Journal.

Mr. Podpeskar received his Juris Doctor degree, magna cum laude, in 1990 from William Mitchell College of Law, where he was executive editor of the William Mitchell Law Review. He received his undergraduate degree, with distinction, from the University of Minnesota in 1980.

Mr. Podpeskar is a member of the American Bar Association; Minnesota State Bar Association; and Hennepin County Bar Association, Environmental Law Section.
